NTSB Factual Report Analysis

An NTSB investigation produces a substantial factual record: group chairman reports, specialist studies, wreckage diagrams, powerplant and structures examinations, and recorded flight data. That record is frequently the starting point for civil litigation. It is not, however, self-explanatory, and the Board’s own analysis and probable cause findings occupy a different evidentiary position than the underlying factual material.

An NTSB docket answers the questions the Board chose to ask, within the scope and resources of a safety investigation. Litigation frequently turns on questions the Board did not reach. Mr. Rexwinkle re-examines the underlying evidence independently rather than restating the Board’s conclusions, and is prepared to explain where his analysis diverges and why.

Experience

Mr. Rexwinkle has investigated more than 300 aviation mishaps since 2008 and has authored over 100 expert reports and technical memoranda synthesizing NTSB material and independent examination into written opinion for use in federal and state litigation.
